1. Annahme der Bedingungen

By downloading, installing, or using Fudini ("the App"), you agree to be bound by these Nutzungsbedingungen ("Nutzungsbedingungen"). If you do not agree to all of these Nutzungsbedingungen, do not use the App. We may update these Nutzungsbedingungen at any time. Your continued use of the App after any changes constitutes acceptance of the updated Nutzungsbedingungen.

2. Beschreibung des Dienstes

Fudini is a pet care companion app that uses artificial intelligence to identify pet breeds from photos, generate health profiles, provide nutrition recommendations, track activity and sleep, deliver daily care tips, and offer a community social feed. Alle features are informational tools only and are not a substitute for professional veterinary care.

3. No Veterinary or Medical Advice

Fudini is not a veterinary service. Alle breed identifications, health profiles, food recommendations, daily tips, activity insights, sleep analysis, and AI-generated content (including Vet AI responses) are produced by artificial intelligence based on the data you provide and publicly available information. These outputs are recommendations and estimates only and may be inaccurate, incomplete, or unsuitable for your specific pet.

You acknowledge and agree that:

• AI-generated content does not constitute veterinary, medical, nutritional, or professional advice of any kind
• Breed identification is an estimate and may be incorrect
• Food recommendations are based on general breed and health data and may not account for your pet's individual needs, allergies, or conditions
• Aktivität and sleep tracking data (from the Smart Collar or manual entries) is approximate and should not be used to diagnose any condition
• You should always consult a qualified veterinarian before making decisions about your pet's health, diet, or medical care
• Fudini bears no responsibility for any decisions you make based on the App's output

4. Acceptable Use

You agree to use the App only for its intended purpose as a pet care companion. You may not:

• Use the App for any unlawful, fraudulent, or harmful purpose
• Attempt to reverse-engineer, decompile, disassemble, or derive the source code of the App
• Interfere with, disrupt, or attempt to gain unauthorized access to the App's servers or systems
• Use automated scripts, bots, or scrapers to access the App or its data
• Sell, transfer, or sublicense your account or access to another person
• Use the App to collect data about other users without their consent
• Circumvent or attempt to circumvent any security or access control measures

5. User-Generated Content & Community Guidelines

Fudini includes a social feed where users can share pet-related photos, tips, and experiences. By using the social features, you agree to the following community guidelines. Fudini has zero tolerance for objectionable content or abusive users.

Prohibited Content

You may not post, upload, or share content that:

• Is hateful, abusive, threatening, harassing, bullying, or promotes violence against any person or group
• Is sexually explicit, pornographic, or contains nudity
• Is violent, graphic, gory, or depicts cruelty to animals or people
• Promotes or glorifies animal cruelty, neglect, or abuse
• Contains spam, scams, phishing, or misleading information
• Infringes on any third party's intellectual property, copyright, trademark, or other rights
• Contains personal or private information of another person without their consent
• Promotes illegal activities, drugs, or controlled substances
• Is defamatory, libelous, or knowingly false
• Contains malware, viruses, or harmful code
• Is not related to pets or the pet community

Reporting & Blocking

You can report any post or user directly from the App using the menu available on each post or user profile. You can also block users to immediately hide their content from your feed. Alle reports and blocks are forwarded to our moderation team for review.

Enforcement

Alle reported content is reviewed and acted upon within 24 hours. Objectionable content will be removed and the user who posted it will be permanently ejected from the platform. We reserve the right to remove any content and suspend or permanently ban any user at our sole discretion, without prior notice, for any violation of these guidelines or for any other reason we deem necessary to protect the community.

6. Content Ownership & License

You retain ownership of the photos and content you upload to Fudini. By posting content to the social feed, you grant Fudini a non-exclusive, royalty-free, worldwide, transferable license to use, display, reproduce, and distribute that content within the App and associated services, including our Bluesky Personal Data Server (PDS). This license exists for the purpose of operating and improving the service.

Alle AI-generated content within the App (breed identifications, health profiles, food recommendations, daily tips, activity insights, Vet AI responses, diary comments) is owned by Fudini and provided to you under a limited, personal, non-transferable license for your own use.

You represent and warrant that you have all necessary rights to the content you upload and that your content does not violate any third party's rights.

7. Smart Collar

The Fudini Smart Collar is an optional BLE (Bluetooth Low Energy) accessory that tracks activity and sleep data. You acknowledge and agree that:

• The collar provides activity and sleep estimates only — it does not diagnose, treat, or prevent any medical condition

• The collar contains a lithium polymer (LiPo) battery — follow all safety instructions provided with the device
• Firmware updates may be provided via the App but are not guaranteed
• The collar is not waterproof unless otherwise specified
• Fudini is not responsible for any injury, damage, or loss resulting from the use of the collar

8. Account & Authentication

Fudini uses device-based authentication by default. Your account is identified by a unique device token generated on your device. You may optionally set up password-based login by providing an email address and password. If you choose to do so, your email and password hash are stored securely on our servers solely for authentication purposes. If you do not set up password-based login and lose access to your device, you may lose access to your data. You are responsible for maintaining the security of your device and login credentials.

9. Termination & Suspension

We reserve the right to suspend or terminate your access to the App at any time, without prior notice, for any reason, including but not limited to:

• Violation of these Nutzungsbedingungen or community guidelines
• Posting objectionable or prohibited content
• Abusive, harassing, or harmful behavior toward other users
• Fraudulent, illegal, or unauthorized use of the App
• Any conduct that we determine, in our sole discretion, is harmful to the community or the App

Upon termination, your right to use the App ceases immediately. We may delete your content and data at our discretion following termination.

10. Disclaimer of Warranties

THE APP AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. To the fullest extent permitted by applicable law, Fudini disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any warranty that the App will be uninterrupted, error-free, secure, or free of viruses or harmful components
• Any warranty regarding the accuracy, reliability, completeness, or timeliness of AI-generated content, breed identifications, food recommendations, health profiles, activity data, sleep data, or any other information provided by the App
• Any warranty regarding the availability, quality, or safety of the Smart Collar
• Any warranty regarding content posted by other users on the social feed

You use the App and rely on its output entirely at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FUDINI, ITS DEVELOPERS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Damages for loss of profits, revenue, data, or other intangible losses
• Any injury, illness, or death of your pet, regardless of cause
• Any adverse reaction or health consequence resulting from food recommendations, dietary changes, or other actions taken based on the App's output
• Any damage to or malfunction of the Smart Collar
• Any loss, damage, or harm resulting from user-generated content or interactions with other users
• Any unauthorized access to or alteration of your data
• Any interruption or cessation of the App's operation

In no event shall Fudini's total aggregate liability exceed the amount you paid for the App in the twelve (12) months preceding the claim, or ten euros (EUR 10), whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Fudini, its developers, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App, your content, your violation of these Nutzungsbedingungen, or your violation of any third party's rights.

13. Third-Party Services

The App integrates with the following third-party services to provide its features:

• Google Gemini AI — for photo analysis, breed identification, and content generation. Subject to Google's Nutzungsbedingungen.
• Bluesky AT Protocol — social feed content is published to our self-hosted Bluesky Personal Data Server (PDS). Posts may be visible to other Bluesky users.
• Expo Push Notifications — for delivering notifications to your device. Subject to Expo's Nutzungsbedingungen.
• Google Cloud Platform — for data storage and hosting.
• Sentry — for anonymous error tracking and crash reporting.

Fudini is not responsible for the practices, policies, or content of any third-party service.

14. Governing Law & Disputes

These Nutzungsbedingungen are governed by and construed in accordance with the laws of the European Union, including the General Data Protection Regulation (GDPR). Any dispute arising out of or relating to these Nutzungsbedingungen shall be resolved in the courts of the jurisdiction where the data controller resides. If any provision of these Nutzungsbedingungen is found to be unenforceable, the remaining provisions shall remain in full force and effect.

1. Overview

Fudini is designed with privacy at its core. We collect primarily pet-related data and basic device information needed to operate the App. We do not require personal identity information to use the App. If you optionally set up password-based login, we store your email address and password hash for authentication only. Your privacy matters — we keep data collection to the absolute minimum required.

2. Information We Collect

Pet data you provide

3. How We Use Your Information

We use the data you provide exclusively to deliver the App's features:

• To identify your pet's breed and generate a health profile

We do not use your data for advertising, profiling, or marketing purposes. We do not build user profiles based on personal identity.

4. AI & Machine Learning Processing

Fudini uses two types of AI/ML processing to deliver its features:

Google Gemini AI (third-party)

Pet photos and health data are sent to Google's Gemini AI API to generate breed identifications, health profiles, food recommendations, daily tips, Vet AI responses, and other AI-powered content.

• Photos are processed in real-time — Google does not store your photos beyond the processing request
• Health and breed data is sent as text prompts to generate recommendations
• AI outputs are cached on our servers to improve response times

Fudini Aktivität ML Model (self-hosted)

We operate our own machine learning model on our servers to classify pet activity data collected from the Smart Collar. This model processes raw accelerometer and sensor data to determine activity types (sleep, rest, walk, run, play, eating, drinking), estimate walk duration, and generate activity insights.

• Collar sensor data is processed entirely on our own servers — it is not sent to any third party
• The model classifies activity patterns to provide you with daily summaries and health insights
• Aktivität classification results are approximate and should not be used for medical or diagnostic purposes

We do not use your data to train or improve our AI or ML models. Your pet's data is used solely to generate results for you.

5. Data Sharing

We do not sell, rent, or trade your data to any third party.

We share data only with the following service providers, solely for the purpose of operating the App:

• Google (Gemini AI) — pet photos and health data for AI analysis
• Expo — push notification delivery tokens
• Google Cloud Platform — data hosting and photo storage
• Sentry — anonymous error reports and crash logs (no personal data included)

6. Data Storage & Security

• Your data is stored on secure servers hosted on Google Cloud Platform in the EU (europe-west1, Belgium)
• Alle communication between the App and our servers is encrypted using TLS with mutual authentication (mTLS) — a client certificate is required for every API request
• Pet photos are stored in Google Cloud Storage with server-side encryption
• Passwords are stored as secure hashes — we never store passwords in plain text
• Device tokens and sensitive data are stored in encrypted database columns
• Our database is backed up daily with 30-day retention

7. Data Retention & Deletion

We retain your pet data for as long as your account is active to provide continuity of service. You can request deletion of all your data at any time by emailing support@fudini.app. Upon receiving your request:

• We will delete all your pet data, photos, posts, diary entries, activity records, and account credentials (email, password hash) within 30 days
• We will remove your social feed posts from our Bluesky PDS
• Anonymized, aggregated data that cannot be linked back to you may be retained for service improvement
• Data required to be retained by law (e.g., legal disputes) will be kept for the legally required period

8. Ihre Rechte

Depending on your location, you may have the following rights regarding your data:

• Access — request a copy of the data we hold about your device and pets
• Deletion — request that we delete all your data
• Rectification — update or correct your pet's information directly in the App
• Data portability — request your data in a machine-readable format
• Objection — object to specific processing of your data
• Restriction — request that we limit how we process your data
• Withdraw consent — you can stop using the App at any time; you can disable push notifications in your device settings

To exercise any of these rights, contact us at support@fudini.app. We will respond within 30 days. Since we do not collect personal identity information, we may ask you to provide your device identifier to locate your data.

Legal bases for processing (Article 6 GDPR):

• Consent (Art. 6(1)(a)) — by accepting the Nutzungsbedingungen of Use and using the App, you consent to the processing of your pet data and optional account data for the purposes described in this policy
• Contract performance (Art. 6(1)(b)) — processing is necessary to provide the App's features (breed identification, recommendations, activity tracking, social feed)
• Legitimate interest (Art. 6(1)(f)) — anonymous crash reporting and service improvement, content moderation and community safety

Data storage location: Alle data is stored within the EU (Google Cloud Platform, europe-west1, Belgium). No data is transferred outside the EU/EEA except when photos are sent to Google's Gemini AI API for processing, which is covered by Google's standard contractual clauses.

Data retention: Your data is retained for as long as your account is active. Upon deletion request, all data is removed within 30 days.

You have the right to lodge a complaint with your local data protection authority if you believe your data protection rights have been violated.

9. Children's Privacy

Fudini is not directed at children under the age of 13 (or 16 in the EU/EEA). We do not knowingly collect data from children. If we become aware that a child has provided us with data, we will take steps to delete that data promptly. If you believe a child is using the App, please contact us at support@fudini.app.

10. Cookies & Tracking

The Fudini mobile app does not use cookies, advertising identifiers, or third-party tracking. Our website (fudini.app) uses only a language preference stored in localStorage — no analytics, no advertising cookies, no third-party trackers.

11. Changes to This Policy

We may update this Datenschutzrichtlinie from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the App after changes constitutes acceptance of the updated policy. For significant changes, we may notify you via the App.
